Correspondence packet from U.S. Treasury Retail Securities Services, Bureau of the Fiscal Service, addressed to Michael Spivey. Dated January 15, 2025. Customer # 0008452580S, Case # 1-9428769711. Mailed from Minneapolis MN 55480 (First-Class, January 16, 2025). The packet includes the Treasury's response to a submitted inquiry regarding Treasury Retail Securities, with notations by Spivey annotating procedural defects: missing OCRID numbers, missing full address, date placement, lack of named representative, and misidentification of the Treasury Office of Inspector General. Spivey's handwritten analysis identifies five factual statements (A–F) as intentionally drafted to divert from the truth, notes the term 'Sovereign Citizen' was used three times to instill fear, and concludes the Notice is null and void ab initio and without any effect.

Document annotated by Mark-Michael Spivey Jr. Key notations: (A) Missing OCRID numbers for entire address; (B–F) Statements labeled as actual facts intentionally drafted to divert from truth; 'Sovereign Citizen' used 3 times; Treasury signature block lacks name, address, office, and contact information of an actual representative; closing reference misidentifies 'Department of the Treasury Office of Inspector General' as 'Treasury Office of Inspector General.' Spivey concludes: This Notice is Unlawful if transmitted properly; THEREFORE, the entire Notice is null and void ab initio and without any effect.

Case Files

Cases initiated or joined by Spivey, with venue, date, and a plain summary of each matter.

On January 28, 2025, the Affiant and exclusive Lawful Owner of the Non-Commercial Vehicle [Non-CMV] — a 2015 Toyota Camry (Black), VIN: 4T1BF1FK8FU049272 — was seized and towed by Towlando Towing & Recovery, 2720 13th Street, St. Cloud, FL 34769, at the request of the Osceola County Sheriff. The Non-CMV was conspicuously marked as Privately Owned, Non-Commercial, and Operating under Sovereign capacity, with a metal plate bearing the numbers 4282164 and marked 'PRIVATE PROPERTY.' On February 10, 2025, Mark-Michael Jr.: Spivey filed an Affidavit of Truth and a True Bill of Presentment against Towlando Towing & Recovery as the 'Unauthorized Third-Party Interloper,' asserting: (1) the Interloper lacked any Lawful Contract, Judicial Authority, Secured-Interest, or Venue; (2) the Interloper failed to provide any valid documentation which would Lawfully Authorize the Seizure of the Secured-Party's Private Conveyance, exclusively pursuant to all Lawful Judgment Lien(s) and/or Contract(s) which bear the Secured-Party's explicit Consent; (3) the seizure constitutes Unlawful Conversion, Trespass to Chattels, Grand Theft Auto, Uniform Commercial Code Violations (Law Merchant included), and Seizure Under Color of Law [U.C.L.]. The True Bill of Presentment was made under the Authority of Common Law, the Uniform Commercial Code (UCC), and the Secured-Party's Inalienable Rights as secured by Natural Law Principles. As of the 7th day of February 2025, the Interloper had continued to Unlawfully retain possession of the Non-CMV. The Demand for Remedy required: immediate release of the Non-CMV without conditions; compensation for all damages, costs, and losses incurred; and Cease and Desist from any further actions infringing upon Secured-Party's Private Property Rights. Failure to Lawfully rebut this Presentment within SEVEN (7) days shall constitute a Default. Vehicle damage documented includes scratches on the entire vehicle, a broken driver door handle, and a dented front bumper. The deputy report documents that Michael advised he did not have and has never had a valid driver's license out of any state, that he is part of the US nationalist group, that he was not driving but traveling, and that he only follows the 'right laws.' DHSMV showed Michael had a suspension for failure to pay a traffic fine on 06/24/24 and showed his driver's license was canceled on 09/16/24. The vehicle was unregistered. Michael was given criminal citations for no DL never had one (citation number: AKSR2LE) and failure to register a vehicle (citation number: AKSR2KE), and a citation for following too closely (citation number: AKSR2ME). The tow sheet lists seized property including one fictitious tag (serial number 4282164) marked 'PRIVATE PROPERTY.' Towlando subsequently issued a Towing Notice of Claim of Lien and Proposed Sale, proposing a public sale at 2720 13th St, St. Cloud, FL 34769, commencing at 7:00 AM on the 16th day of March, 2025.

Outstanding fees total $562.00, including $392.00 Felony Adj Guilty Court Costs, $100.00 Cost of Prosecution ASA/JAC, $3.00 Teen Court Fee, and other costs. Bail was posted on January 30, 2025 by Jaymes Acosta of Moncrief Bail Bonds (License #W301096, NPN #18438147, Business Address: 1632 Hawksbill Ln, Saint Cloud, FL 34771, County: Orange), with three surety bonds through United States Fire Insurance Company: Power #U5-21809944 ($500.00, Arrest #25CF279-1, Charge: Operate Motor Vehicle W/O Valid [License]), U5-21809945 ($250.00), and U5-21809946 ($500.00). The Power of Attorney was issued January 30, 2025, and is void if altered, erased, or used with other powers from the company or in combination with other surety companies, or to furnish bail in excess of the stated face amount. Bond consideration included a Promissory Note, Indemnity Agreement, Mortgage Deed, Contingent Promissory Note, Vehicle Title, Cash, and Collateral Receipt #396144. All three bonds were discharged August 22, 2025 (Certificate of Bond Discharge, signed by Karina W., Deputy Clerk, Case Judge Keith Carsten). CONTRADICTIONS & ISSUES: The Florida Department of Financial Services Licensee Search for Jaymes Acosta shows a Qualifying Appointment of YES but also shows an Invalid Licenses Status of INVALID. The search results include a TEMPORARY LIMITED SURETY AGENT (BAIL) (T0235) license issued 1/8/2016 bearing the name HEATHER ELIN WEST, which expired 7/8/2017 and is listed as INVALID. The Continuing Education Status for Acosta is listed as In Progress. The presence of an invalid Temporary Limited Surety Agent license in the search results raises questions about the licensing and authorization of the bonds posted in this case. The case was closed with all three charges adjudicated guilty, with $562.00 in outstanding court costs and fees.

A formal demand letter dated July 22, 2024 to the U.S. Department of Veterans Affairs Debt Management Center (P.O. Box 11930, St. Paul, MN 55111-0930) regarding the remaining VA debt balance. Michael Manuel Spivey asserts that on May 10, 2024 he mailed a U.S. Postal money order (Serial No. 29135827664) in the amount of $35.00, with the memo line 'BALANCE PAID IN FULL,' delivered per tracking number 9589071052701202242455. He contends that the VA's acknowledgment and cashing of the money order, combined with the memo and the endorsement terms on the instrument, constitute full satisfaction of the debt under U.C.C. § 3-311, U.C.C. § 1-303(a), and Restatement (Second) of Contracts § 277(1) (Accord and Satisfaction). The VA's letter dated May 10, 2024 acknowledged receipt but erroneously indicated a remaining balance of $13,300.78 and continued to demand payment.

The letter demands immediate cessation of all unauthorized deductions from his service-connected VA compensation checks, which he states have occurred since approximately April 2021 without authorization and constitute a seizure of property without due process. He demands a full refund of all amounts deducted in error, immediate clearance of the account to a zero balance, written confirmation of these actions, and a detailed investigation into the unauthorized deductions, all within 15 days of confirmation of receipt. The package was served via Certified Mail No. 9589071052701202218849 from the USPS office at 4701 Old Canoe Creek Road, Saint Cloud, FL 34769, and includes a Certificate of Service, the front and back of the money order, the VA receipt letter, and USPS inquiry documentation. Signed under 28 U.S.C. § 1746 as Michael Manuel Spivey, Foreign American National and Secured Party Creditor, Without Prejudice, U.C.C. 1-308, All Rights Reserved.

Michael Manuel Spivey served as Veteran Peer Support Specialist in the SSVF Department at The Transition House, Inc. (TTHI), 8 Broadway Suite 100, Kissimmee, FL 34741, from approximately October 2022 through June 2024. During his tenure, Spivey: established an active collaboration between TTHI and CareerSource for Work Release Veterans (confirmed by email from DVOP Specialist Yinette Lizardo, August 24, 2023); secured news coverage through News Channel 13 (journalist Massiel Leyva, November 7, 2023) for community work performed for TTHI; developed a program to motivate and inspire incarcerated individuals participating in the TTHI Work Release program; used his personal funds for company vehicle fuel and events without seeking reimbursement; received CEO Melissa Lucas's written gratitude for his contributions to the team and congratulations on achieving six years of sobriety (January 4, 2024); and was granted CEO permission on March 25, 2024 to use TTHI branding, name, image, and logo for his social media testimonials, book, and videos. An incident occurred on February 7, 2024 at the TTHI SSVF Department's Office involving Christopher O'Connor, Lynette Machado, and Yubetsy Alamo, where Christopher exhibited aggressive behavior and made threatening statements. Spivey submitted his resignation letter on June 4, 2024 (final working day June 19, 2024), citing a reduction in his community outreach activities and perceived lack of loyalty from leadership, and surrendered his office key to Lynette Machado. CONTRADICTIONS & ISSUES: (1) THREAT REPORT: On March 14, 2025, CEO Melissa Lucas filed a report with the Osceola County Sheriff's Office (Incident 251027776, D/S M. Maisonette, Nature: THREATS 14R, disposition Closed) stating that Spivey had resigned, was homeless, and had mental health concerns, and that she feared he might show up at her business locations — despite the FBI itself noting that the term 'sovereign citizen' is used to label people as domestic terrorists. (2) PTO CANCELLATION: Spivey's approved Paid Time Off was cancelled, with the organization citing a policy that disallows PTO during a notice period, which Spivey disputed. Spivey claimed Lynette Machado utilized his vacation time without his consent and approved his hours for payment in full before he left, noting a discrepancy in organizational policy regarding sick time usage. Lynette Machado was accused in a handwritten note of violating the National Labor Relations Act (NLRA). (3) EQUIPMENT DISPUTE: Andrea Villacreses requested the return of company property, including a T-Mobile Samsung A12 phone, a Microsoft Surface Pro, and a Surface Pro pen, which Spivey disputed, alleging fraudulent/forged documents. (4) TTHI announced 2024 grant allocations including pay increases and scheduled performance evaluations for SSVF Team members in May and June. (5) TTHI refused to provide Spivey with recommendation letters, and Spivey alleged that Lynette Machado made public derogatory remarks about his resignation and mocked his spelling.

Notice of Violation No. 276240002 issued by the City of Orlando Orlando Stops Traffic Safety Program (P.O. Box 4990, Orlando, FL 32802) alleging a red-light traffic signal violation. On January 5, 2024 at 1:54 PM, the vehicle, a 2015 Toyota Camry (VIN 4T1BF1FK8FU049272, tag XC0XE), was photographed entering the intersection at WB E South St @ S Rosalind Ave/SR 527 against a red signal, in alleged violation of Florida Statutes 316.0083, 316.074(1), and 316.075(1)(c)1. The civil penalty is $158.00, due March 12, 2024, with no points assessed against the driving record.

Michael M. Spivey filed an Affidavit dated March 11, 2024 contesting the Notice of Violation on Due Process grounds under the U.S. Constitution and Florida Constitution Article I, Section 9. He argues that the alleged violation is by definition a victimless crime, that the violation documentation coerces payment through bold-lettered threats of license points, higher penalties, and suspension, and that the program has not shown beyond a reasonable doubt that the registered owner was operating the vehicle at the date and time in question. He asserts protected status as a federally protected veteran under VEVRAA (Vietnam Era Veterans' Readjustment Assistance Act of 1974) and sets conditional terms: should the City pursue the matter and the result be an acquittal, mistrial, dismissal, withdrawal, diversion, or any public record of the defendant's legal name, the City agrees to pay $777.77 per day for any required appearance and $7,777.77 per infraction for public embarrassment and slander under false pretenses.

Second filings in Case No. 6:25-cv-01299-CEM-RMN, dated October 30, 2025. Includes Exhibit 1 listing certified mail tracking numbers (PS Form 3800) for all named defendants, including the State of Florida, Office of Ron DeSantis, Florida Department of State, Osceola County agencies, and individual defendants. Also includes a Dun & Bradstreet DUNS number lookup confirmation for the State of Florida (DUNS No. 004078374) dated October 21, 2025, and Affidavits of Truth addressed to Danielle Veronica Sommer (former employer, The Transition House, Inc.) and to the Faone family members, executed under 28 U.S.C. § 1746(1). CONTRADICTIONS & ISSUES: The Dun & Bradstreet confirmation proves the STATE OF FLORIDA is registered as a corporate entity (DUNS No. 004078374) in the federal contractor database — not a de jure government — confirming the affidavit's claim that all sub-agencies operating under it are incorporated entities engaged in commerce without valid business licenses. The Affidavit addressed to Danielle Veronica Sommer documents that The Transition House, Inc. and its representatives fabricated allegations of credit card theft and fraud that led to the deactivation of Spivey's cell phone, despite Cash App records proving the payments were legitimate. The affidavit further records reasonable belief that Sommer colluded with family members to coordinate an attempt on Spivey's life after his release from Osceola County Jail, and that FOIA requests transmitted to the U.S. Treasury, USPS, and U.S. Department of State to validate communications regarding transmitted bonds (including an Apostille Birth Certificate, SS Card, and DD-214) went unanswered — indicating interference with federal correspondence.

The Court found that Plaintiff failed to effectuate service on defendants — certified mail is insufficient for service of process under Federal Rule of Civil Procedure 4. The Court also conducted a sua sponte review and identified the complaint as a shotgun pleading requiring repleading. CONTRADICTIONS & ISSUES: The court dismissed the case for 'failure to serve' despite the fact that Spivey filed Certificates of Service (Doc. Nos. 17 & 18) with certified mail tracking numbers proving delivery to every named defendant — including the Osceola County Corrections Department, whose envelope was received and opened (proven by the resealed tape documented in the USPS/Collusion file). The court ruled that 'certified mail is insufficient for service of process' under FRCP 4, yet simultaneously refused to address that summonses were never issued by the Clerk's office — placing the burden on a pro se litigant for a clerical function the court controls. The court labeled the complaint a 'shotgun pleading' to justify dismissal, while never reaching the substantive allegations of constitutional violations, fraud, color-of-law actions, or racketeering. The Motion for Temporary Restraining Order was denied without any hearing on the merits, leaving the documented harms unaddressed.

Civil Action No. 6:25-CV-1299 (CEM-RMN), United States District Court, Middle District of Florida, Orlando Division. Plaintiff: Mark-Michael Spivey Jr. v. State of Florida et al. The initial filings include the Affidavit of Truth and a Certificate of Service showing service upon the Osceola County Clerk of the Court, Administrative Law Judge Keith A. Carsten, and State Attorney Monique H. Worrell on July 15, 2025. Also includes the Court's Order denying without prejudice the Motion to Proceed In Forma Pauperis (Dkt. 3), signed by Magistrate Judge Robert M. Norway on July 15, 2025, and a court receipt showing $408.00 paid by credit card on July 31, 2025. CONTRADICTIONS & ISSUES: Magistrate Judge Norway denied the Motion to Proceed In Forma Pauperis on the basis that Spivey 'did not submit the proper long form Application' — a procedural technicality — while ignoring the substantive allegations of constitutional violations, color-of-law actions, and racketeering documented in the complaint. The court demanded the $405 filing fee, which Spivey paid in full on July 31, 2025 ($408.00 including fees), proving his ability and willingness to proceed. The Certificate of Service documents that the Osceola County Clerk, Administrative Law Judge Keith A. Carsten, and State Attorney Monique H. Worrell were all served on July 15, 2025 — yet these same parties would later be cited by the court as 'unserved defendants,' contradicting the proof of service on file.

Contains an Affidavit of Truth filed by Mark-Michael Jr: Spivey addressed to the Office of Governor Ron DeSantis and all sub-agencies operating under the STATE OF FLORIDA (DUNS No. 004078374), including The Florida Bar, Florida Secured Transaction Registry, DHSMV, FDLE, and others. The affidavit asserts that the STATE OF FLORIDA is a federally registered corporation engaged in commerce and alleges that state officers are acting in a de facto capacity without properly filed oaths of office or surety bonds. Also includes The Florida Bar's response letter dated November 18, 2025 (RFA No. 26-5621) from Bar Counsel Diane Suhm, stating that The Florida Bar is the licensing agency for attorneys and cannot review disciplinary inquiries against law firms, corporate entities, or state agencies — only against individual attorneys. An Inquiry/Complaint Form was enclosed. CONTRADICTIONS & ISSUES: The Florida Bar's response claims it 'cannot review disciplinary inquiries against law firms, corporate entities, or state agencies' — yet The Florida Bar is itself a corporate entity that regulates the practice of law statewide. The Bar's refusal to identify or discipline individual attorneys acting under color of state agencies creates a circular shield: the Bar says it cannot act against agencies, and it will not name the individual attorneys within those agencies unless Spivey identifies them himself — effectively blocking any accountability for attorneys who issued unlawful filings, false statements, or color-of-law actions. The affidavit documents that no current or properly filed Oath of Office or Official Bond for Governor Ron DeSantis or numerous other officers could be produced upon public records inspection, meaning these actors are operating in a de facto capacity without lawful commission under Article II Section 5(b) of the Florida Constitution and Florida Statutes §§ 876.05–876.09 and § 113.07.

Osceola County Sheriff's Office Incident Number 251010014. Defendant: Michael Spivey, DOB 11/20/86. Nature: Traffic Stop. Affiant: Deputy J. Wybiral (ID 2787), dated January 28, 2025. The documentation includes a Signature Affidavit, Vehicle Tow Form, Property Receipt, and Call Detail Report. The traffic stop occurred at New York Ave & 7th St, St. Cloud, FL 34769 on January 28, 2025 at approximately 11:20 AM. The vehicle, a 2015 Toyota Camry (VIN 4T1BF1FK8FU049270), was towed by Towlando to 2720 13th St, St. Cloud. Reason for tow: Driver Arrested, Charges DWLS (Driving While License Suspended). Inventory of impounded property includes paperwork, license plates, a red passport holder with documents, currency, and tribal identification cards. CONTRADICTIONS & ISSUES: The property receipt lists tribal identification cards and a red passport holder with documents that were seized during the stop, yet the defendant was charged with DWLS — a charge that does not account for why identification documents, currency, and personal effects were inventoried and held. The vehicle was towed by a private company (Towlando) before any hearing or due process, and the inventory form notes '37 Fake $100 bills' among seized items, raising questions about the basis for examining and cataloguing currency during a routine traffic stop. The deputy's signature affidavit is dated 01/28/25 — the same day as the stop — suggesting the arrest report was prepared contemporaneously without independent review.

Mark Michael Spivey submitted a request to the U.S. Department of State for authentication of a Certificate of Live Birth (COLB) for use in Indonesia. The document records the Department's response regarding the authentication request and addresses the condition of the submitted document, which was reportedly damaged in the handling process. CONTRADICTIONS & ISSUES: The U.S. Department of State's response claimed that 'no further authentication was required' for the document's use in Indonesia — yet the submitted Certificate of Live Birth was returned damaged, raising the question of why a federal agency charged with authenticating vital records would damage and return a lawful document rather than completing the requested apostille. The damage to the COLB aligns with the pattern documented across these files of federal and state agencies interfering with Spivey's lawful correspondence, destroying or altering documents, and suppressing proof of identity and status. This file is part of the broader FOIA request record transmitted to the U.S. Treasury, USPS, and U.S. Department of State that went unanswered.

Documents a USPS Priority Mail shipment from Mark-Michael Jr. Spivey to the Osceola County Corrections Department mailed on October 30, 2025 (tracking #9505506585865303629688). USPS tracking initially showed "Delivered, Left with Individual" in Kissimmee on November 3, 2025, but the status later changed to "Addressee Unknown" and the package was processed for return. The package was delivered back to the sender in Orlando on November 7, 2025. Witness Ross J. Nichelson Jr. testified on November 10, 2025, that the envelope addressed to the Osceola County Corrections Department was found opened and resealed with clear tape, indicating it had been received and opened by the addressed party before being returned. CONTRADICTIONS & ISSUES: The USPS tracking number (9505506585865303629688) no longer displays tracking information when queried online — the tracking history has been deleted or suppressed from public view, indicating corruption and collusion at USPS to conceal the proof of delivery. The tracking initially confirmed "Delivered, Left with Individual" on November 3, 2025, proving the Osceola County Corrections Department received the package — yet the status was then fraudulently changed to "Addressee Unknown" to justify returning it. The witness testimony of Ross J. Nichelson Jr. confirms the envelope was opened and resealed with clear tape before return, proving the Corrections Department received, opened, and read the contents before falsely claiming the addressee was unknown. This constitutes mail tampering under 18 U.S.C. § 1702 and obstruction of correspondence, with both USPS and the Osceola County Corrections Department complicit in destroying evidence of lawful service.

Affidavit of Truth filed by Mark-Michael Jr: Spivey on October 30, 2025, against family members including Debra Anne Dimodica (FAONE), Carolanne Maria Solis, Carol Faone (Sierra), Darlene Faone, Michael Faone, Michelle Faone, and Victoria Faone. The affidavit alleges a long-term pattern of manipulation, deception, coercion, physical abuse, and financial interference causing mental, emotional, physical, financial, reputational, and familial harm. The affiant identifies as a Private American National, Sui Juris, and Secured-Party Creditor. Filed under Federal Rules of Civil Procedure Rule 9(a), Rule 17(a), Rule 11(b), and Title 28 U.S.C. § 1746(1). The affidavit demands the respondents cease all harmful actions and provide a sworn written response within ten days. CONTRADICTIONS & ISSUES: The affidavit documents that family members made false statements, interfered with Spivey's private affairs, unlawfully retained monetary funds, and manipulated legal documents to access his assets — conduct that directly contributed to his homelessness. The respondents are accused of acting in concert with state actors and former employers to coordinate harm for financial gain. The affidavit was filed into the federal record (Case No. 6:25-cv-01299-CEM-RMN) yet the court never addressed these allegations, dismissing the case on procedural grounds instead. The demand for a sworn written response within ten days, with failure to respond constituting tacit acquiescence and admission under FRCP Rule 36(a), went unanswered by every named respondent — establishing their default in commerce.
